Temporary Employment Visa H-L-O-P-Q
Details:
Generally, a citizen of a foreign country who wishes to enter the United States must first obtain a visa, either a nonimmigrant visa for a temporary stay, or an immigrant visa for permanent residence. Temporary employment visas are for people who want to enter the U.S. for a job that lasts for a specific period of time and are not considered permanent or indefinite. Each of these visas requires the prospective employer to first submit a petition to the U.S. Citizenship and Immigration Services (USCIS). An approved petition is necessary to apply for a temporary employment visa.
The temporary employment visa categories are:

H-1B: Person in a Specialty Occupation

To work in a specialty occupation. Requires an advanced degree or its equivalent.


H-1B1: Free Trade Agreement (FTA) - Chile, Singapore

To work in a specialty occupation. Requires a secondary degree that signifies at least 4 years of study in that specialization (This visa does not require a previous petition).


H-2A: Seasonal Farmer

For temporary or seasonal agricultural work. Limited to citizens or nationals of certain countries only.


H-2B: Non-Temporary Farmer

For temporary or seasonal non-agricultural work. Limited to citizens or nationals of certain countries only.


H-3: Special Education or Training

To receive non-medical or non-academic training that is not available in the country of residence.


L: Intra-Company Transfer

To work in an affiliate, branch or subsidiary of the current employer, in a managerial or executive position. Must have worked at least one year with the employer.


OR: Individual with Parrots or Extraordinary Abilities

For individuals with extraordinary achievements or abilities in fields such as science, art, education, business, and athletics.


P-1: Individual or Team Athlete or Member of an Entertainment Group

To participate in a specific competition as a member of a team or individually.


P-2: Artist or Entertainment

To participate in a presentation as part of a reciprocal exchange between an American and a foreign organization.


Q-1: Cultural Exchange Participant

To participate in training, work or story exchange in a cultural exchange program between the U.S. and the foreign country.
